'4 <br />m <br />1 <br />A RESOLUTION GRANTING A <br />CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE SECTION 10.03, SUBDIVISION 21 <br />AND A VARIANCE TO SECTION 10.22, SUBDIVISION 2 <br />AND SECTION 10.56, SUBDIVISION 16(L)(2) <br />FILE NO. 2486 <br />WHEREAS, Elaine E. Erickson, (hereinafter "the applicant") is the owner <br />of the property located at 1270 Spruce Place within the City of Orono (hereinafter "the City") <br />and legally described as follows: <br />Lot 2, Block 10, Saga Hill Revised, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit per <br />Municipal Code Section 10.03, Subdivision 21 for grading within 5' of a lot line, and a variance from <br />Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L)(2) to permit construction of a <br />new residence allowing 2,647 s.f. (46.93%) of hardcover in the 75-250' setback area where 1,682 s.f <br />(27.55S %) exists and 1,525 s.f. (25%) is allowed; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on April 17,2000, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2486. <br />2. This property is located in the LR-1B Zoning District, where 1 acre or 43,560 s.f is <br />the minimum lot area.
