Owners hereby agree to the terms of this agreement and <br />on behalf of themselves, their heirs, successors ».nd as­ <br />signs, hereby agree to the recording of this agreement in <br />the chain of title of their subject properties. <br />In 19B5 absent the executed agreement <br />The City must once again ask the residents to share in the solu­ <br />tion of this dilema. without the necessary covenants and as the City <br />has done before, a building permit was issued to John Thimmesh for a <br />48 foot length dock for apparently 2 slips. The dock has been placed <br />as with the others with a zero side yard setback with each slip width <br />at 9 feet. The dock does not appear to encroach the dork use area- of <br />the adjacent users. Unfortunately without the necessary contrr.. rn <br />use, Thimmesh (Tract S) has gone ahead and installed an electrical <br />cable from Cook's dock (Tract E) and juried the cable underground <br />within Tract R,0,N and K without proper authorization. I have not <br />checked with Thimmesh but I would imagine he never received a permit <br />from the State Inspector authorizing the installation. In fact, <br />Thimmesh installed the dock without a building permit. <br />There are other violations or irregulaticns within the subject <br />1. Gasoline tank within Tract E must be removed from lake <br />immediatly - Cook. <br />2. Canvas top has been stored on Tracts Q & P for the past two <br />years - it must be removed cr installed over dock as in past but <br />not left on shore - Nutt. <br />3. Garbage continues to bo a problem on non-resident tracts. <br />4. Grass is not maintained on non-rosident tracts - potential <br />violation of municipal ordinance. <br />The Marina Committee must sec that the following is included in <br />any agreement by the residents: <br />X. For safe navigation of limited lagoon - controls for dock <br />size and limit of boats stored at docks. <br />2. Updated registration each season with the City advising of <br />current ownership, license numbers of boats stored at dock and <br />insurance certificate for each boat. <br />area: <br />• - J <br />-I
