A RESOLUTION VACATING <br />AN UNIMPROVED LANE WITHIN THE PLATS OF <br />"WILEY ’S NAVARRE ADDITION", "TOWNSITE OF <br />LANGDON PARK " AND "LAFAYETTE RIDGE " <br />IN THE CITY OF ORONO, <br />HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 2567 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on February 16, 2000, Walfred Properties (hereinafter the <br />"applicant") filed a petition with the City of Orono requesting the vacation of an unimproved <br />public right-of-way adjacent to their property and originally dedicated in the plats of "Wiley ’s <br />Navarre Addition", "Townsite of Langdon Park" and "Lafayette Ridge" Hennepin County, <br />Minnesota legally described as follows: <br />Attached as “Exhibit A’ <br />WHEREAS, after due published and posted notice, a public hearing was held <br />by the Orono Planning Commission on March 20, 2000, regarding said vacation and all <br />interested persons were given an opportunity to be heard; and <br />WHEREAS, on April 17, 2000 the Planning Commission recommended <br />unanimous approval of the vacation in conjunction with approval of a commercial site plan <br />review proposed by the applicant; and <br />WHEREAS, the City Council of the City of Orono finds that said vacation as <br />proposed is in keeping w'ith the public interest and in consideration of the following findings: <br />1. The lane has never been developed for any public purpose. <br />2. The lane does not provide access to any adjoining or nearby properties. <br />3.This unimproved right-of-way contains municipal sewer, water, gas and telephone <br />utilities.
