ORONO PLANNING COMMISSION <br />MONDAY, NOVE^roER 15,1999 <br />(#2549 David Lovelace, Continued) <br />themselves or the City will be faced with deciding where the dock access will be located. <br />Mrs. Uran suggested that perhaps Mayor Jabbour has a conflict of interest in this matter since he is <br />a property owner on Big Island. <br />Chair Hawn pointed out that Mayor Jabbour is not present tonight. <br />Kluth stated If Mayor Jabbour feels there is a conflict of Interest that exists in this matter, he can <br />excuse himself. <br />Chair Hawn stated the City would like the property owners on Big Island to come to a solution that <br />the parties can live with. Hawn pointed out the members of the Planning Commission have a <br />difficult time gaining access to this area and are unfamiliar with the layout of the land. <br />Kluth stated he was in agreement with Hawn, and urged the local residents on Big Island to reach <br />an amicable solution among themselves. <br />It was the consensus of the Planning Commission that the property owners on Big Island reach an <br />amicable solution among themselves regarding dock access for the inland landlocked property <br />owners. <br />Egan stated the landlocked property owners purchased the property on Big Island knowing it was <br />landlocked at the time. <br />Lovelace remarked he is entitled under City Ordinance to apply for dock access, and indicated he <br />would be willing to sit down with the other residents of Big Island in an attempt to reach a workable <br />solution. <br />Egan Inquired whether the land needs to be developed prior to dock access being granted. <br />Gaffron stated City Code allov/s property owners on Big Island to have dock access to their property <br />even If it is undeveloped. Gaffron stated the City of Orono is required under Ordinance to provide <br />dock access to the landlocked parcels. Gaffron indicated he would be willing to work with the <br />property owners on Big Island in an effort to resolve this matter and is in support of providing one <br />dock access for the inland property owners. <br />Chair Hawn stated due to the suggestion by City Staff to have the property owners arrive at a <br />workable solution among themselves. Hawn inquired whether the Applicant would be willing to have <br />this application tabled and to waive the 60 days. <br />Lovelace stated he would be willing to have his application tabled and to waive the 60 days. <br />Lovelace requested that a deadline be set in which this matter should be resolved. <br />Egan stated since the’ir boats are in storage for the winter and it would be difficult to access <br />Big Island at this time, he suggested they be given until late spring to resolve this. Egan noted that <br />some of the property owners are only available during the summertime. <br />Lovelace pointed out that the residents will still need to follow the rules set by the governing body of <br />the lake. <br />Smith commented that City Staff could assist the property owners in that regard. <br />Page 24
