Lot of Record. A lot of record is any lot for which a deed or registered land <br />survey has been recorded in the office of the Register of Deeds or the Registrar of Titles <br />for Hennepin County, Minnesota, prior to January 1, 1975, and after approval by the <br />Council if required. <br />Source; Municipal Code <br />Effective Date: 9-14-67 <br />A.Existing Lots. A lot of record existing upon January 1,1975 in an "R” District, <br />which does not meet the requirements of the Zoning Chapter as to area or width <br />may be utilized for a single family detached dwelling purpose provided that in the <br />judgment of the Council such use does not adversely affect public health or safety <br />and the following requirements are met; <br />Source: City Code <br />Effective Date; 4-1-84 <br />3.In "R" Districts Not Served by Public Sanitary Sewer. A lot of record <br />in any "R" District in the City not served by public sanitary sewer must <br />meet the area and width requirements of the Zoning Chapter and shall not <br />be utilized for single family detached dwelling purposes without Council <br />approval. <br />Source: City Code <br />Effective Date; 4-1-84 <br />In the Filbrandt situation, the 3 record lots total only 9 acres in a 5-acre zone, and norie of the <br />three record lots individually contains 5 dry buildable acres. No permits for construction of a new <br />residence on any of the three existing lots could be issued without City Council approval of lot <br />area and/or width variance (which would normally be predicated on septic capability, access, <br />etc.).
