Council Action Requested <br />To provide direction to the applicant on the following issues: <br />1. <br />2. <br />3. <br />4. <br />Is it in keeping with the intent of the zoning code and Comprehensive Plan to rezone the <br />property from 5 acre minimum lot size to 2 acre minimum lot size? <br />Should the property be permitted to develop beyond one residential unit based on a total of <br />26 acres of land and that three separate tax parcels exist? This option would require at least <br />a variance for lot area on one lot. Any subdivisions requiring variances involve “flexible <br />zoning” requiring a plat. <br />The City of Orono has commonly treated lot line rearrangements between 2 developed <br />parcels as a Class I subdivision. A Class I subdivision would not require replatting even <br />when the resulting lots do not meet lot width or area standards. This proposal would result <br />in one non-conforming, undeveloped lot. <br />The 3 record lots total only 9 acres in a 5 acre zoning district, and none of the 3 lots <br />individually contains enough dry bulldable acres to be considered a record lot. Building <br />permits can not be issued for construction of a new residence on any of the three lots without <br />approval of variances for lot area and possible lot width.
