4. <br />5. <br />A.The Lake Minnetonka Conserv ation District has issued a permit for the dock <br />extension of 14 feet. <br />B.The Hennepin County SherifFs Water Patrol has reviewed the request and <br />determined the dock extension does not create a navigational problem. <br />C. Several adjacent property owners have expressed concerns regarding safe <br />access to the channel for their individual docks if the extension is approved. <br />D.To not further obstruct access to the channel no parking of boats shall be <br />allowed on the 14 foot extension. Only that portion of dock that had existed <br />previously shall be permitted for boat parking. <br />The City Council finds that granting a conditional use permit to permit a 14 foot <br />extension of the existing permanent dock will not be detrimental to the health, safety <br />or general welfare of the public, will not adversely affect light, air nor pose a fire <br />hazard or other danger to neighboring properties, nor will its use depreciate <br />surrounding property values and that the proposed level of use of the property will <br />be in keeping with the intent and objectives of the Zoning Code and Comprehensive <br />Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by staff and comments of the <br />applicant and the affect of the proposed use on the health, safety, and welfare of the <br />community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby grants <br />a conditional use permit per Municipal Zoning Code Section 10.55, Subdivision 9(B), to permit a <br />14 foot extension to an existing permanent dock, subject to the following conditions: <br />1.
