<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7336 <br /> <br /> <br />1 <br /> <br />A RESOLUTION <br />APPROVING VARIANCES FROM <br />MUNICIPAL ZONING CODE <br />SECTIONS 78-1279, 78-1680, & 78-1700 <br /> <br />FILE NO. LA22-000055 <br /> <br /> WHEREAS, on October 19, 2022, Travis and Sara Wildenberg (hereinafter the <br />“Applicants”), applied for variances from the City Code for the property addressed 3838 Cherry <br />Avenue and legally described as: <br /> <br />Lots 8 and 9, Block 3, Crystal Bay View, Hennepin County, Minnesota <br />(hereinafter the “Property”); <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variances from Orono Municipal Zoning Code Section 78-1279 to allow construction of a second <br />story addition 20 feet from the OHWL where a 75-foot setback is required and lakeward of the <br />average lakeshore setback line; and <br /> <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br />variances from Orono Municipal Zoning Code Sections 78-1680 and 78-1700 to permit 32.9% <br />hardcover where 33.9% currently exists and 25% is permitted to construct additions to the existing <br />home and change the hardcover; and <br /> <br /> WHEREAS, on November 21, 2022, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the opportunity <br />to speak thereon; and <br /> <br /> WHEREAS, on November 21, 2022, the Planning Commission reviewed the <br />application and provided direction to the Applicants for revisions; the Planning Commission <br />recommended denial of the variances as applied; and <br /> <br /> WHEREAS, prior to City Council review, the Applicants provided amended plans <br />reflecting the proposed second story 32 feet from the OHWL and a proposed hardcover reduction <br />resulting in 7,380 square feet (32.6%) total hardcover; and <br /> <br /> WHEREAS, on January 9, 2023, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff and directed preparation of findings <br />for approval of the variances reflected on the amended plans. <br />
