Theses are lakeshore lots without <br />a principal structure and are not in conformance with the current zoning codes. The zoning code <br />requires a principal structure (residence) on a parcel before a dock is permitted. Since these lots <br />were created before the current zoning code was in effect, the City Council previously approved <br />resolutions granting a "Conditional Use Permit” (CUP) to allow for continued use of these dock lots <br />by owners who do not reside in the immediate neighborhood. . . <br />The City Council recently passed a resolution requesting that Hennepin County install "No Parking” <br />signs along both sides of County Road 19 in this area. This was based on safety concerns from <br />parked cars and turning vehicles. The original CUP resolutions stated that parking for the dock lots <br />was supposed to occur on the small lots adjacent to ti.e dock lots. Easements between all of the dock <br />lot owners were supposed to be granted to allow travel across these small lots for parking purposes. <br />All of these easements were not completed when the original CUP’s were obtained. Over the past <br />several years, parking for use of these dock lots has been occurring on County Road 19. Since this <br />is no longer possible, the easement situation needs to be finalized at this time. <br />City staff, Hennepin County Highway Department staff, and Don Miegel, one of the dock lot <br />ovsners, recently met on-site to review options for parking. Our understanding is that Hermepin <br />County is willing to issue an entrance permit to formalize access for these lots. In the past, access <br />from County Road 19 had been occurring on an informal basis. <br />Based on the steep hillside, there are only two locations where a driveway access is feasible. Based <br />on the site topography, the preferred location is on the "Ginther and Ault” parcel. The second <br />alternative would be on the "Huber” property. Hennepin County will only issue one entrance permit <br />to serve theses dock lots, and will require proof of cross easements before an entrance permit is <br />issued. <br />Telephone (612) 249-4600 • fax (612) 249-4616
