The County Board requires that each municipality that will retain its own <br />jurisdiction over ISTS must submit a formal statement to that effect prior to 1-1-2000. <br />It is clearly the City’s intent to continue local jurisdiction over ISTS. A number of facets of the <br />County ordinance are worthy of note: <br />Individuals may construct their own ISTS serving their own dwelling, but it must <br />have been designed by a State-licensed ISTS professional <br />Existing systems with at least 2 feet of separation between the distribution medium <br />and the seasonally saturated zone will not be required to upgrade if: <br />- the system is not an Imminent Public Health Threat; <br />- the system is not in Shoreland; <br />- the system is not in a wellhead protection area; and <br />- the system does not serve a food/beverage/lodging facility <br />(Note: the above matches the new State regulations, with the exception that the State <br />requires existing systems built after April 1,1996 to have 3’ of separation) <br />Failing systems shall be upgraded within 3 years, and County may grant a 2-year <br />extension. Systems that are considered as posing an imminent threat to public health <br />or safety must be upgraded in 10 months. <br />Separation distance to a Type 3,4, 5 or 6 wetland is 50 ’ (our standard is 75 ’) <br />Alternative and experimental systems are only allowed where a standard system <br />cannot be used <br />Warrantied systems are prohibited
