Russell road a letter from <br />Mr. Johnson's attorney to the Village <br />Attorney followed by the reading of the <br />two ordinances pertaining to filling <br />low lands. Mscussion was then held on <br />the legality of Mr. Johnson's application <br />as to whether a building permit could be <br />withheld if a person could build on a lot <br />if all aspects of the codes were met. <br />Mr. Johnson cxiilained that the biggest <br />problem in construction was the constrtiction <br />of an adequate septic system and that he <br />I was assured by a reliable contractor it <br />' could bo done. Russell then explained <br />that the reason for the ordinance covering <br />filling was the village's concern for t!»c <br />la?;c, that ponds nnd wetlands orcveiit <br />rapid Tiui off of water and act* as a <br />filtering agent to water entering Lake <br />Minnetonka. McCarthy stated that so many <br />applications for filling, similar to this, <br />are being taken out, that some place a <br />stand would have to be taken and lines <br />drawn and held so there would not be a <br />wholesale filling of these lands, <br />niscussion was then held on the platting <br />of Myrtlcwood and that future platting <br />should dedicate these lands so no <br />construction could take place on them. <br />Members concurred that there was no legal <br />ground to deny the permiv. <br />Dongoskc moved, Kullberg seconded, to <br />recommend approval. Motion, Ayes (S) - <br />Nays (0). <br />Mr. Sabor represented the Jehovah lfitn«5scs <br />I in an application for a conditional use <br />permit to erect a church on Ella Gruppe <br />property, part of Lot 7, Block 10, Lnngdon <br />Park, 3675 Togo Rond.
