The buildings would remain <br />on the property, in the case of the existing house would be smaller and used only as <br />accessory to the new house that would be constructed on the lot. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not alone a hardship. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />The use of the property would remain residential which is a permitted use in the zoning <br />district. <br />The Board or Council may permit as a variance the temporaiy use of a one-family <br />dwelling as a two-family dwelling. <br />The applicant will not be changing the itwelling status of the property. <br />The special conditions applying to the structure or land in question are peculiar <br />to such property or immediately adjoining property. <br />The lot has an existing house, detached garage and boathouse. A variance is required to <br />permit the 16' X 23.8' boathouse to remain on the property. The existing house is not <br />proposed to be removed, but would rather be converted into an accessory building to the <br />new house. The existing house would be resized to meet a 10' setback from the street. <br />The boathouse has been located on the property for many years. The property owner has <br />staled the building has historic value and adds character to the property. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />The building and boathouse are preexisting structures on the property. If the boathouse was <br />destroyed or removed a separate variance review would be required.
