ABC Supply <br />AprU 4.2001 <br />Page 2 <br />The conditional use permit review period is approximately 60 days, and requires a public hearing <br />with the Planning Commission prior to City Council review. The earliest possible dale at which a <br />public hearing could be held is May 21, 2001. The application deadline for the May 21, 2001 <br />Planning Commission meeting is April 18. 2001. The City Council has the authority to set <br />reasonable conditions as it relates to outdoor storage on the property, should the conditional use <br />permit be approved. The primary concerns will be screening, lighting, noise, parking, signage and <br />hours of operation. Because the property is located adjacent to residential uses, the preferred <br />screening would be some form of natural buffer (trees, shrubs, etc.). <br />It is our understanding there is no retail component to the use of the property. Retail uses are not <br />permitted in the I. Industrial District. I have attached a copy of Section 10 50 of the Municipal Code <br />relating to properties in the industrial district. <br />The parking standard does not permit any parking within 20* of any right of way. Currently, cars are <br />being parked along Old Crystal Bay Road and may be in violation of the setback requirement. <br />(Section 10.61. Subdivision 5 (C)). <br />Section 10.60. Subdivision 8 requires that lighting shall be directed downward to not be visible at <br />any lot line. Lighting in all instances shall be ditTused or directed away from any residential district. <br />Residential districts arc located to the west of the property across Old Cry stal Bay Road and to the <br />south of the property across the railroad tracks. <br />1 have attached a copy of the conditional use permit application form, noise ordinance and above <br />referenced code sections. <br />Please contact me at your earliest conv enience to discuss the issues noted above.
