ANALYSIS <br />The Planning commission may recommend and the Council may grant a conditional use permit if <br />die following findings arc made: <br />Vhtt the proposed location of the conditional use is in accord with the objectives of the <br />Zoninfi Chapter and the purposes of the district in which the site is located and <br />Comprehensive Municipal Plan. <br />The proposed conditional use is in accordance w ith the Municipal Code because an <br />accessory structure on a through lot located in a "R" District is listed as a conditional use. <br />That the proposed local ion of the condiiional use and the proposed condition under <br />which it would be ofKraledor maintained would not he detrimental to the public health, <br />safety or welfare, or materially injurious to profn-rties or improvements in the vicinity. <br />The proposed conditional use would not be detrimental to public health, safety or welfare. <br />The proposed accessory building Is 20' ,x 24* or 480 s.f. An accessory structure of this <br />sl/e is to be liKated at least 10* from the side property line. ITie accessory structure is <br />proposed to be located 50 ’ from the property line as shown on the surscy (l-xhibit B). <br />It meets setbacks and does not exceed the height of the principal building, therefore is <br />considered as conforming. Further, it will be located at least 70* from the nearest <br />roadway and will not appear as an encroachment of any rcquirc*d street yard. <br />That the proposed conditional use will comply with each of the applicable provisions of <br />the 7.oniny Chapter <br />The use w ill not conflict with other provisions of the Zoning Chapter. <br />Issues fur Considenilion; <br />I. Does Planning Commission find that the proposed use will not be detrimental to the <br />neighborhood? <br />2. The accessory building meets setbacks from both Old Beach Road and Mapleridge Lane. <br />3.
