C'2 <br />CONDITIONAL USE PERMITS <br />Communities frequently misunderstand both the level and the nature of the discretion that they <br />have in the review of conditional use permits They often treat their review as though they were <br />legislative approvals like a rezoning. rather than the administrative decisions that they are <br />rONDITIONAl. rSE PERMIT nFFINITION STANDARDS <br />ORDINANCE DEFINITION <br />The following is a good example of an ordinance definition and the standards for its approval <br />(A) <br />ijMli <br />Purpose. “Conditional use” means a land use or development as defined by ordinance that <br />would not be appropriate generally but may be allowed with appropriate restrictions as <br />provided by official controls upon a finding that 1) certain conditions as detailed in the <br />Zoning Ordinance exist. 2) the use or development conforms to the Comprehensive Land <br />Use Plan of the City and 3) is compatible with the existing neighborhood <br />Application. Public Hearing. Notice and Procedure The application, public heariig. public <br />notice and procedure requirements for conditional use permits shall be the same as those <br />for amendments as provided in Section 10-5-6 of this Chapter, except that the permit shall <br />be issued on the affirmative vote of a majority of the entire Council Although specific <br />submissions required to complete an application for a conditional use permit may vary <br />with the specific use and the district in which it is located, all applications for such permits <br />must include at minimum a site plan that clearly illustrates the following proposed land <br />use. building mapping and functions, circulation and parking areas, planting areas and <br />treatment, sign locations and type, basic lighting concerns, the relationship the proposed <br />project to neighboring uses, environmental impacts and demand for Municipal services <br />Standards The Planning Commission shall recommend a conditional use permit and the <br />Council shall issue such conditional use pr^nits only if it finds that such use at the <br />proposed location <br />Will not be detrimental to or endanger he public health, safety, comfort, <br />convenience or general welfare of the neighborhood or the City <br />Will be harmonious with the general and applicable specific objectiv es of the City’s <br />Comprehensive Plan and this Title <br />Will be designed, constructed, operated and maintained to be compatible in <br />appearance with the existing or intended character of the general vicinity and will <br />not change the essential character of that area <br />- 6 -
