The site plan, attached as Exhibit D. is the site plan that is approved by Staff and meets the <br />requirements of the zoning chapter. The grading plan has addressed the concerns by Staff regarding <br />proper drainage on the property. Swales arc being provided around the house to direct water from <br />the road, driveway and roof around the house and beyond the adjacent homes where the water will <br />then naturally flow towards the lakeshore. <br />In addition to the drainage s\sales. gutters are being added to the northeast roof line to direct water <br />towards the front of the house and not towards the neighboring house. Draintile will also be installed <br />to take the w ater from the house around to the front of the bank. Final grading and the draintile w ill <br />not be completed until the ground thaws in the Spring. Because the additional grading and drainage <br />improvements can not be completed until Spring, staff will be issuing the (T .C.O.) rather than a final <br />Certificate of Occupancy (C.O.). When the improvements are complete a C.O. could be issued. The <br />City of Orono has routinely allowed individuals to occupy a home by a T.C.O. without all the <br />exterior work being complete subject to a defined time period to complete the work. <br />T’ariance Request: <br />Driveway <br />The property owners have submitted an approved site plan, revised 12/28/00 by Alta Survey <br />Company. Exhibit D. As previously stated the plan removed a portion of the driveway and a paving <br />stone patio. Staffhas determined the approved driveway is acceptable to provide access to and from <br />the street and garage. However, the property owners had originally requested a wider drive to allow <br />more space to maneuver a vehicle, and are requesting approval to install the wider driveway. <br />Patip/Steos <br />Secondly, the paving stone patio being requested is a ground level patio located below a patio door. <br />The second issue is how to access the patio door since placing a small stairway with a landing up to <br />the patio door absent the paving stones would also constitute hardcover. Two issues to discuss are <br />the 1 ) variance to permit a patio and/or 2) variance to permit hardcover to allow a stair access to the <br />patio door. There would be about a 3-4 foot drop to the ground without a stairway. The State <br />Building Code does not permit patio doors without a safe landing. The City has required the <br />property owners block the door so it cannot be opened more than 4 inches. Without blocking the <br />door the home could not be occupied. <br />Patio Dbcuuion: <br />The natural grade below the patio door has been altered to accommodate a raised area. The grade <br />can be changed in this area by 2 '/j feet. Ihc raised elevation is equivalent to the height of a <br />patio/deck that is permitted without being considered ‘•structure’’ ahead of the average lakeshore <br />setback. Most of the patio would be closer to the lakeshore than the average lakeshore setback line. <br />The code prohibits any patios/decks over 6' in height from being located closer to the lakeshore than <br />adjacent residential buildings.
