Guest houses must meet minimum princi(>al building setbacks and be located behind the principal <br />residence. The RR-IB zoning district requires the following: <br />RR-IA <br />(acre) <br />Lot Area Lot IVidth Front Yard Side Yard Rear Y'ard <br />Required 2 acres <br />4 ocres for a <br />guest house <br />200'50*30'50* <br />The property does meet the minimum requirements for a guest hou^e. <br />Septic: <br />Septic Design has been provided to the City of Orono. 1 he design work shall be approved by the <br />On-Site Systems Manager prior to a building permit being issued. <br />Guest House Variances: <br />Section 10.28, Subdivision 5 (A) establishes the ma.\imum building height for structures to be 2 '/j <br />stories or 30 ’ in height. Technically, the building would require a variance for height because a part <br />of the house is 3 full stories. A '/j story would be the portion of living space within a gabled roof <br />line, for example. Because the architectural style has a flat roof, it leaves a full three story house 30 ’ <br />in height. <br />A second height variance is required for a 30" high railing that would be located above the roof line. <br />The railing would be placed on the roof for safety purposes. A variance is required because the <br />railing is considered part of the stmeture over 30* in height. <br />Conditional Use Permit - Primary Rcaidence: <br />Section 10.75, Subdivsion I would allow height limitations for chimneys to be increased by 50% if <br />the Cit>' Council approves a Conditional Use Permit. The Building/Firc Code requires chimneys to <br />be 2* higher than any portion of the house within 10’. The proposed chimney is for a total of 6' in <br />height where 2’ would be allowed. The added 4’ of height requires the CUP. There is one chimney <br />on each end of the house, each with a defined height of 35 feet 8 inches. <br />Staff Recommendation: <br />Staff recommends approval of the requests subject to the proper^ owners agreeing to file a <br />restrictive covenant in the chain of title of the property that would limit use of the guest house to <br />occupants, guests or domestic employees or by persons who would otherwise be expected to live in <br />the primary residence on the property, and that the guest house could not be used for a home <br />occupation. <br />>2650 Kimcn miO P«ndi B«tM <br />2601 IUifK> Road <br />CorKliiictuI L’i« Pcrmil and Vviancct <br />p^3or) <br />1 <br />•i
