0 <br />MINUTES OF A REGULAR MEETING HELD AUGUST 21, 1972 <br />3. The owner of Lots 4 {{ 5 also owns Lots <br />1-2*3 with a hoUse On Lots 1 f| 2i <br />4. Lot 3 is a drainage lot for the entire <br />area and forms a natural barrier between <br />Lots 4-5 and l-2« <br />In view of the above. <br />Van i^est moved, Ryerse seconded, that approval <br />be recommended, subject to the village <br />Engineer approving street, and drainage. <br />Motion, Ayes (9) - Nays (0), <br />Ron Bowen represented Bruce Dayton in an <br />application for a iJico of Ordinance No; 125, <br />dredging a ponding area and dispersing the <br />spoils on various places on property he owns. <br />Discussion was held on whether the Village or <br />the Minnehaha Creek Watershed District gives <br />the first opinion on the application. Van <br />Nest stated Ordinance No. 125 reads that the <br />Minnehaha Creek Watershed District does. <br />Minnehaha Creek Watershed District informed <br />tho secretary that they felt tne Village should <br />as they are involved with many villages, having <br />various ordinances, and they had to form opinions <br />on matters that are legislated differently in <br />tiiese villages. Southworth was of the opinion <br />that our ordinances should be amended so the <br />procedure is clearly defined. Van Nest <br />stated Ordinance No. 125 states these variances <br />siioulu be evaluated in the light of what the <br />public benefits by tiic variance, and to him <br />this was private benefit. Mr. Bowen stated <br />Mr. Dayton's long range plan is that this <br />property would eventually have public benefits <br />as it was expected that one day they would be <br />opened to tho public in the form of nature <br />trails. Van Nest also opined that too little <br />was yet known about the harm or good to be <br />derived from disturbing the swamp, and he was <br />concerned with placing the spoils across <br />East Long Lake Road near Long Lake. It was <br />then brought out rlr. Dayton would not place <br />any fill nearer than 80* from the lake in <br />compliance with Ordinance No. 125. <br />Searles moved, Southworth seconded, that <br />approval be recommended conditioned that the <br />project also conform to the Minnehaha Creek <br />Watershed District's recommendations. <br />Motion, Ayes (8) - Nays (0). <br />Q William Wear represented himself in an <br />application to construct a commercial complex <br />consisting of a gasoline island, a small strip <br />shopping center and a proposed apartment <br />building.
