Side Setback: <br />The garage as proposed is 5’ from the side lot line and 8’ from the neighboring residence structure. <br />A 10’ lot Ime setback is required. Applicant wishes to have a 5’ setback to avoid relocating the <br />gravel driveway. <br />Neighborhood: <br />The neighborhood has a mixture of attached and detached garages. Tlie properties that have <br />detached garages, the garage is located either on the side or in the rear of the property. 1 his property <br />is unusual for the neighborhood because the house is located so far back on the property. Driving the <br />neighborhood, most homes are located much closer to the road. A garage could not be constructed <br />on the rear of the property due to the topography and lack of space. <br />3436 Livingston Avenue - <br />Granted a variance in 2000 for a garage. <br />Approved 1,968 s.f. (43.4%) hardcover in 500-1000’ setback. <br />Existed - 1,816 s.f. (40.3%) Allowed - 1,575 s.f. (35%) <br />Setback - 5’ side yard instead of 10’ <br />Adjacent property garage located 3’ from property line. <br />Met lot coverage by structures. <br />3477 Livingston Avenue - <br />Granted a variance in 2001 for garage <br />Approved Setback - 5’ side yard instead of 10’ <br />Met hardcover and lot coverage by .structures. Structures met 10’ setback. <br />Exhibit E shows the size of other properties in the Livingston Avenue neighborhood. Ihc subject <br />property is similar to other lots in the neighborhood. <br />Statement of Hardship: <br />The applicant has included their statement of hardship in Exhibit C. The applicant should also be <br />asked for their testimony regarding this issue. <br />I.ssues for Consideration: <br />1. The existing residence was built in the early 1960’s, prior to current zoning standards. <br />2.
