o; ^m^ ^ fj ^ <br />'•v <br />'XeWEPm COUNTY TAXPAYER 8ERV1CCS <br />6984334 <br />12 tQ9B CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 144 <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />' SECTION 10.24, SUBDIVISION 5 (B); <br />SECTION 10.22, SUBDIVISIONS 1 AND 2; AND <br />SECTION 10.56, SUBDIVISION 16 (L) (1)&(2) <br />FILE #2390 <br />WHEREAS, Jodi Rahn and David Rahn (hereinafter "the applicants") are owners <br />of the property located at 1385 Rest Point Road within the City of Orono (hereinafter "City") <br />and legally described as follows: <br />Lot 23, and all that part of Lots 15 and 22, and adjacent vacated alley. Subdivision of <br />Lot 14, Rest Point Park, Lake Minnetonka, lyi-g Southerly of the following-described <br />line: Beginning at a point on the Southeasterly line of said Lot 15, distant 75 feet <br />Northeasterly from the Southeasterly comer of said Lot 23; thence Northwesterly to the <br />Southeasterly comer of said Lot 22; thence Northwesterly on a line forming an angle <br />of 74 degrees 55 minutes with the Easterly line of said Lot 22, to the shore of Lake <br />Minnetonka, and there ending (hereinafter the "property"); and <br />WIIEREaS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held public hearings on July 20 and August 17, 1998, at which times all persons <br />desiring to be heard concerning this application were given the opportunity to sp.ak thereon; <br />and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B); Section 10.22, Subdivisions I and 2; Section <br />10.56, Subdivision 16 (L) (1)&(2) to pemiit construction of a two story 20’x20’ (400 sq. ft.) <br />garage. Variances are required for street yard setback to allow- the garage to be located 17.1' <br />from Rest Point Road per the plan in Exhibit B. Variances for hardcover in the 75-250’ <br />setback to allow an additional 1,051 sq. ft. of hardcover for a 20’x20’ two story garage, 350 <br />sq. ft. for a driveway, 19 sq. ft. for a garage apron and 282 sq. ft. for a 3'x94' sidewalk. <br />Page 1 of 5
