Proposed Dcvcionmcnt <br />The cast '/i of the property proposed for de\ elopment is zoned B-4 and is guided for commercial use <br />by the Comprehensive Flan (CMF). 1 he z.oning code states the district is intended to prov ide a <br />district which is related to and may adjoin residential districts or other business districts for the <br />location of administrative office buildings and related offices. 1 he office uses allowed in this district <br />are those in which there is limited contact with the public and no exterior display or selling ol <br />merchandise to the general public. The district shall have immediate access to adequate highways <br />and public sanitary sewer. <br />Offices are a permitted use in the li-4 district. <br />Permitted/Conditional Residential U.ses in I.R-IB district <br />The west Vj of the proposed development is zoned residential. Any office use would require the <br />property to be rezoned. Under the current zoning district the property could be used for single family <br />residential use. Another residential option on the property would be a “duplex”. A duplex could be <br />constructed on the property only after approval of a conditional use permit by the City Council. <br />One duplex may be located on a single lot as a conditional use provided that public sanitarv' sewer <br />service is available, the lot is adjacent to a commercial district and the duplex is constructed within <br />200' of the commercial district, further the duplex must be built on a lot that meets minimum lot <br />size and lot width standards for the district. <br />Code Kevievv/Flatting Process: <br />The Zoning Ordinance does not have a process that would allow the proposed development. A FI il) <br />process is only available to commercial properties located within Highway 12 Development <br />Corridor. Froperties in the B-4 di.strict are required to have a minimum lot size of 20.000 s.f and <br />a lot width of 100'. Required building setbacks are 35' to a front property line. 1 5' to a side property <br />line and 35' to property line adjacent to an “R". residential district. <br />The proposed plat can be compared to a ‘■t»)wn house ” plat, where each individual building is located <br />on an individual lot. In thiscase. individual lots would have a lot area of 2.100 s.f to 2.500 s.f and <br />the buildings would hav e a zero setback to the property lines. <br />* Required Code Amendment <br />A process would be required to be established to allow commercial properties to have the Ilexibility <br />to allow the development to create individual building lots that would allow 0 setbacks and lots less <br />than 20.000 s.f in the zoning district. It Wi)uld require the City of Orono adopt a new FUD process <br />for commercial properties. <br />ResiJeniuilly zoned property can develop as either a Flanned Residential Development (FRD) or a <br />Residential Flanned Unit Development (RFI T)).
