August 8, 1979 <br />Mr, Timothy J. Petersen <br />280 Orono Orchard Road <br />Conditional Use Permit/Variance <br />Page 2 <br />#500 <br />STAFF NOTE - AUGUST 30, 1979 <br />I note for the record the following information received from <br />the staff at the Orono Golf Course. The top of the 85* antenna <br />collapsed after a severe storm some time in June and remained <br />in that state for a few weeks, Mr. Petersen repaired the antenna <br />without clearing it with the Building and Zoning Staff. At the <br />time the applicant repaired the antenna, he had not filed a formal <br />application with the City but he had been notified by the Building <br />Inspector of the need for a conditional use permit and received <br />copies of the sections of the ordinance on May 31, 1979. (See <br />enclosure) <br />Conditional Use Permit - Portion <br />Points to consider in review of the conditional use permit application: <br />1. <br />2. <br />Dimunition in neighboring property v'alues. <br />Adverse visual ^pact factor - at what height does an antenna <br />become incompatible in a residential neiguborhood? <br />3.In a residential zone should the height of an antenna be determined <br />by the applicant's desired range of transmitting or receiving? <br />4. Does the very nature of this hobby suggest a certain degree of <br />preparation or groundwork before one as knowledgeable and <br />experienced as Mr, Petersen moves into a community? <br />Please review the following section of the Ordinance: <br />32.460 Conditional Uses: Granting of Permit The City Council may <br />grant a conditional use permit as the use permit was applied for or <br />in modified form, if on the basis of the application and the evidence <br />submitted, the City makes the following findings: <br />(a) That the proposed location of the conditional use is in <br />accord with the objectives of the Zoning Code and the <br />purposes o^ the district in which the site is located; <br />(b) That the proposed location of the conditional use and the <br />proposed condition under which it would be operated or <br />maintained would not be detrimental to the public health, <br />safety or welfare, or materially injurious to properties <br />or improvements in the vicinity; and <br />(c) That the proposed conditional use will comply with each of <br />the applicable provisions of the Zoning Code. <br />A conditional use permit may be revokable, may be granted for a limited <br />time, or may be granted subject ot such conditions as the City Council <br />may prescribe.
