Pearce <br />1405/1485 Sixth Avenue North <br />SUBDIVISION <br />Page 2 <br />n ^ <br />b) The granting of the request will not be detrimental to <br />the public welfare or injurious to other property in <br />the territory in which said property is situated; and <br />c) The variance is necessary for the preservation and <br />enjoyment of a substantial property right of the <br />petitioner. <br />Please note the following findings of fact. <br />1. A residential structure does not lie within subject <br />property. <br />2. The proposed subdivision does involve a private roadway <br />serving three residential lots. <br />STAFF NOTE - AUGUST 21, 1979 <br />Issue of Metes and Bounds vs Platting of the subdivision <br />Staff Recommendation - After meeting wxth the applicant and reviewing <br />the issues and unique background of the subject property, staff <br />recomniends a metes and bounds division for the Pearce subdivision <br />based on the following findings: <br />Access 1ssue <br />1 The existing private driveway will serve no more than the three <br />i^rcels ihe ?ls?rictive covenants filed with this P^oP^^ty limits <br />^h^nu^ber of residences to three. Document No. 558151 has been added <br />to the files for your review. <br />2 The applicant could construct another^ approach serving the two <br />n4wly created parcels.
