Mabusth, Zoning Administrator IT jV: O' Ij DATE: SUBJECT: July 3, 1979 #489 KK & Kompany, 1140 North Arm Drive Conditional Use Permit - Change of Occupant involving a legal non-conforming use Zoivfi’g District LR-IB Keith Katcher and Tony Brown request a Conditional Use Permit to permit their boat operation in a residential district. The original use of an auto repair shop was recognized as a legal non-conforming use. The City requires a new conditional use permit when there is a change of occupant. The building inspector feels this operation is conducted under better supervision than the previous auto repair. The building and approximately 50' X 150' of land is rented by the KK Kompany from Leo Duehn. The company employs five full-time employees (3 for engine repair - 2 for boat refinlshing). In the Winter the operation slows down to two full-time employees. The hours of operation are 7:00 A.M. to 6:00 P.M. but in the summer It could extend to 8:00 P.M. depending upon work load. At the time of the Inspector's first call there were nine boats on the property; when I was out on a site inspection on July 2, 1979 there were only five. Please note the boats being stored to the rear of the property are not involved with this operation. STAFF UPDATE - JULY 12, 1979 Planning Commission advised staff to reevaluate this application for a conditional use permit. Planning Coiranission questioned "basis of authority for this body to act on the application" or could this type of request be simply reviewed by Sta>ff with the issuance of a Certificate of Occupancy. It is the Zoning Administrator's opinion upon review of the following ordinances and the issues raised by this new use that this application will require a new conditional use permit before a certificate of occupancy can be issued.
