The <br />original use of an auto repair shop was recognized as a legal <br />non-conforming use. The City requires a new conditional use <br />permit when there is a change of occupant. The building <br />inspector feels this operation is conducted under better <br />supervision than the previous auto repair. <br />The building and approximately 50' X 150' of land is rented by <br />the KK Kompany from Leo Duehn. The company employs five full-time <br />employees (3 for engine repair - 2 for boat refinlshing). In <br />the Winter the operation slows down to two full-time employees. <br />The hours of operation are 7:00 A.M. to 6:00 P.M. but in the <br />summer It could extend to 8:00 P.M. depending upon work load. <br />At the time of the Inspector's first call there were nine boats <br />on the property; when I was out on a site inspection on July 2, 1979 <br />there were only five. Please note the boats being stored to the <br />rear of the property are not involved with this operation. <br />STAFF UPDATE - JULY 12, 1979 <br />Planning Commission advised staff to reevaluate this application <br />for a conditional use permit. Planning Coiranission questioned <br />"basis of authority for this body to act on the application" or <br />could this type of request be simply reviewed by Sta>ff with the <br />issuance of a Certificate of Occupancy. <br />It is the Zoning Administrator's opinion upon review of the following <br />ordinances and the issues raised by this new use that this application <br />will require a new conditional use permit before a certificate of <br />occupancy can be issued.
