James Gilbert* Attorney for the Smerling*s* <br />we herein wish to indicate our opinion related to the need for a retaining wall <br />on the Holzer Property. <br />After having viewed the site* it is our opinion that the wall constructed <br />on the Holzer site is not needed for erosion control. The Holzer site is at <br />the crest of a hill and drainage runs in all directions. If it was the inten­ <br />tion to retain drainage from the Holzer front yard (lakeside)* and pipe this <br />drainage directly to the lake* it could have been done much less offensively <br />than building a large retaining wall. Simple site grading on the yard and <br />construction of a sump to collect drainage vrould accongilish the same result <br />as relates to drainage. The sump would have a pipe discharging doim to the <br />lake. <br />Very little* if any* drainage ran off of the Holzer front yard to the <br />Smerling Property. That is obvious by examining the site. We understand <br />that the conflict relates to the wall* its height* placement and obstruction <br />of the view.
