i! <br />n <br />January 16, 1979 <br />Alexander Holzer <br />2677 Casco Point Road <br />Varlance/Condltlonal Use Permit <br />Page 5 <br />:^4'3 <br />PLANNING COMMISSION MEETING - JANUARY 22, 1979 <br />The Chairman announced that he was contacted by Mr, Smerling <br />who asked that all discussion and action be postponed for a <br />future Planning Commission meeting. Mr. Hassel agreed to the <br />request and advised the Commission that the Holzer application <br />would be scheduled for the Planning Commission's first meeting <br />in March, Commission members took the opportunity to counsel <br />both Mr. Mitchell and Mr. Neklch that it would be advantageous <br />for both parties if an agreement or a narrowing of issues could <br />be reached before the scheduled meeting. The attorneys agreed <br />to meet within the next two wedcs. <br />STAFF NOTE - JANUARY 23, 1979 <br />Village Planner called both attorneys to reaffirm the Planning <br />Commission's counseling and was advised by both that they plan <br />to begin negotiations within days. <br />PLANNING COMMISSION MEETING - MARCH 12, 1979 <br />Mr, Mitchell, attorney for the Holzers, contends the main purpose <br />for erecting the retaining wall was to prevent erosion and that new <br />drainage plans improve old drainage patterns. Planning Commission <br />requested that the City Engineer work with the applicant's engineer <br />to evalxiate the structure and consider the following points: <br />1. Determine original ground level - "previous condition of site". <br />2. Maximum (or minimum) height wall must be to function as an erosion <br />control device. <br />3. Depth of original footing? Are they deep enough to be effective <br />in erosion control. <br />4. Extent of original land alteration - where excavated material was <br />placed on the lot. <br />5. Hardcover violation within 75' lakeshore setback: <br />A) Integrity of structure destroyed by removing wall above ground <br />level within restricted area. <br />B) Value of retaining footings In this area.
