He under- <br />sto^ there were misunderstandings, but felt that the <br />problems had been solved. The Peterson's purchased this <br />property in good faith. <br />Pesek moved. Van 1,'est seconded, to approve this variance <br />because it is after the fact and the pool has been tliere <br />for the past three years. Pesek felt that this was not a <br />violation by the Peterson’s idio purchased the property only <br />one year ago. They were unfortunate to inherit an existing <br />non-confonning situation w)iich was never before brought to <br />the attention of staff. Motion - Ayes (8), Nays (0)T <br />Mr. Curtis ivas in attendance and presented pictures of his <br />property. After a short discussion, ?-fcDonald moved, Pesek <br />seconded, to grant approval of this variance because the <br />proposed addition wuld be replacing the substandard leanto <br />portiOT of the house and it would in no way encroach on the <br />existing setbacks, htotion - Ayes (8), Nays (0). <br />The Zoning Administrator presented the building plans to <br />^e ConmissiOT. Mr. Ryan was present to explain his plans <br />for this additiCHI. Van Nest moved, Guthrie seconded, to <br />recoinmend approval subject to providing fire separations <br />as r^^r^ by the State Code and the combinaticjn of all <br />the ^dividual parcels and vacated street. The subject <br />of the vacated street should be referred to the attorney <br />to resolve its actual status. <br />were in attendance. Mrs. Smith explained <br />to the Conmission that at the start of the construction <br />they instructed the contractor not to disturb the trees <br />that were on the property in order to build the house. <br />The l^ation of the house was then moved over to avoid <br />removing the trees. The inspector was never informed <br />of the change in lcx:atian. Larry Shaw, a neighbor to <br />^e north of the Smith’s was also present at the meeting. <br />He expressed his disappointment with the building of this <br />u *1* n*cntioned that he conplained several times to <br />Uie building inspector regarding the building location. <br />Smith’s home blocks his view <br />of the lake. The Planning Commission felt that the only <br />question here was the rear yard setback as the new <br />sideyard setback requirements. <br />Pesek mov^, Hake second^, approval of this variance <br />ecause the house is finished.
