^1 <br /># <br />i <br />i <br />m <br />4 <br />IIB^ <br />MINUTES OF A PLANNING COMMISSION MEETING HELD OH DECEMBER 10, 1979 <br />The Planning Commission met on the above date. Present <br />were the following members: Chairman Wilson, Frahm, <br />Hammerel, Hannah, Jabbour and McDonald. Mabusth, <br />Olson and Gaffron represented the City staff. <br />Chairman Wilson announced the Public Hearing. Mabusth <br />stated she had the Affidavit of Publication. Olson <br />reviewed Council * s original request and directives for <br />amending the fence ordinance. Planning Commission was <br />to make recommendations for changes or additions for <br />Council's review. <br />Mrs. George Garske, 1265 Shoreline Drive, the only <br />member in the audience to address the fence ordinance, <br />presented photographs of her lakeshore property to <br />the Commission. She stated that the new ordinance <br />would prevent her from putting up a 6* privacy fence <br />along her side property line to block the site and <br />noise of the neighbor's dogs. The neighbors have <br />a dog run located 8' from their side property line. <br />The Planner commented that with the new ordinance <br />she could construct such a fence as long as it was <br />set 10' from her side property line. <br />Ad€nns arrived. <br />McDonald was concerned that non-conforming existing <br />fences or walls would be permitted to remain in place. <br />She reflected on the condition and type of fences or <br />walls constructed by the commercial marinas. She <br />questioned the City's ability to enforce the conditions <br />set forth in the agreements entered into by the marina <br />owners with the City. <br />Wilson questioned the taking of property owner's rights <br />by not allowing them to construct a privacy fence of 6* <br />on their own property. <br />Due to another public hearing, the following discussion <br />was continued after the public portion of the meeting. <br />Jabbour felt that the requirement of 20% opaqueness <br />was unrealistic and recommended adjusting this standard <br />to allow the construction of traditional wooden fences. <br />Adams felt that more than screening should be required <br />for dumpsters. <br />ATTENDANCE <br />7:30 P.M. <br />FENCE ORDINANCE <br />Public Hearing <br />7:30 P.M.-8:00 P.M, <br />7:35 P.M.
