He stated that the <br />house meets all setback requirements but that due <br />to a surveyor’s error of 20' a variance would be <br />required for the wall and canopy. An 18* variance <br />is required for the farthest point of the wall <br />because it is above the 42" height and a 2* variance <br />for the canopy extending into the 35* front yard <br />setback. The wall will be landscaped to soften the <br />effect. Also present were Ma’ind and Gretchen Hurr, <br />930 Partenwood Road, who were v^pposed to any <br />variance being granted as they contend that tl^ <br />house violates the covenants of Partenwood. They <br />presented pictures of the previous and existing <br />grades. The Commission advised the Hurrs that the <br />City cannot do anything regarding the Partenwood <br />covenants. Mr. Safar stated that he would contact <br />his architect to see if there is a more feasible <br />way to achieve the canopy without the need for a <br />variance or at least as great a variance as now <br />requested. <br />Jabbour moved to deny the wall and canopy as <br />proposed but would be willing to reconsider <br />the cenopy If resubmitted without the well. <br />Motion seconded by Hammerel, Vote: Ayes (5), <br />Nays (I) Wilson Wilson felt the Item should <br />be tabled, he was uncomfortable handling the <br />request piecemeal and felt the alternatives <br />should be considered as a who^e. <br />JACK SAFAR <br />925 Partenwood Road <br />VARIANCE <br />(#485) Cont. <br />Mr. Foster was present. No public comments were <br />heard. Mr. Foster presented tentative plans for <br />the addition and remodeling.
