Letter from Mr, Coffin <br />has been received certifying two-acres dry <br />buildable area within Lot 2, Block 1. All <br />requirements have been met. The two farm <br />buildings may not be used until a principle <br />use is established. <br />Hammerel moved to approve the plat in accordance <br />with the Resolution. Motion seconded by Hurr. <br />Vote: Ayes (6), Nays (0), Motion passed unanimously. <br />Mrs, Moe was present. The main discussion was <br />concerning the engineers recommendation that the <br />City obtain a 5* easement on either side of the <br />pipe if the line will drain property owned by <br />anyone other than the Moes. After discussion, <br />it was decided that because of the unusual number <br />of easements already existing on their property <br />that the Planning Commission did not feel that <br />the 5* easement should be required. <br />McDonald moved to approve the Conditional Use <br />Permit contingent upon engineer*s recommendations <br />that the culvert should outlet at the normal <br />elevation of the lake, rip rap should be placed <br />at the outlet and the manhole be constructed as <br />a sump, however, the 5' easement would not be <br />required. Motion seconded by Hannah. Vote: <br />Ayes (6), Nays (0), Motion passed unanimously. <br />Mr, Oliver was present. Mabusth stated the <br />applicant has been informed that the unit cannot <br />be used as a ’’rental unit”. The house is in the <br />process of being sold, and although the unit had <br />been rented until the fire, Mr. Oliver stated he <br />wanted to reconstruct it as a guest house. Due <br />to the difficulty of policing these uses, there <br />was concern about granting this request among <br />some of the Planning Commission members, however, <br />some of them felt that with so many of these <br />guest houses throughout Orono why shouldn't this <br />request be granted? Staff will check on the number <br />of sewer units assessed to this property.
