REGULAR MEETING OF THE ORONO COUNCIL, OCTOBER 30, 1979 Page 9 <br />I agree with Mr. Obe^hauser's surunary items on Page 4, <br />as follov/s: <br />/ <br />CONDITIONAL USE <br />3701 Shoreline Di <br />1.The zone should be changed to B-4. There is no <br />logical reason to include the sewer line in this <br />zone (the owner would have access to the sewer <br />regardless of zone) . The actx.al zone boundary <br />should include all commercial functions including <br />parlcing, and perhaps should go to the west line <br />of Lot 6. The depth would not need to be 200' <br />as this is obviously flood plain and wetlands. <br />A reasonable straight line comoroinise should be <br />determined through the rezoning process. <br />The conservation and flowage easement should be^ <br />over all designated flood nlain, i.e. over all ^1 <br />land below 935. If some of this land is not ® <br />wetlands, some of the normal conservation proJiibitions <br />could be amended as long as the flowage easement is <br />assured. <br />(Continued) <br />3.I agree with the concept of Item 3, although I <br />thin)c the facts make any difference between <br />wetlands and flood pluln ra"* ner rr.:;?t, or insignifi <br />cant at best. This does not mean l.ljat I could not <br />find hardships to justify some variance to the 26' <br />rule such as the suggested narking lot retaining wall <br />Council Meeting - October 30, 1979 <br />* ••Mr. Oberhauscr, Bill McQueen, and John Nelson were present <br />Mr. McOx.een reviewed a survey of the propertv in question <br />commenting that he purchased the property in 1966 and 1967 <br />and that tnis property was assessed as cominercial property <br />for sewer and water. <br />Mayor Van Nest commented that the B-1 change was completed <br />in 1974 to include this commercial nronerty after dis <br />covering oiiunissions in the 1967 legal descriptions. <br />John Nelson discussed concept of the proposal commenting <br />that the proposed building would be rental, i:ot condominiums <br />and that we want to develop an office building of a <br />residential looking type of structure ov;ned and ooeratcd <br />only as an office building. <br />Mr. Oberhauser reviewed the history of the land and the <br />plans for development commenting that the wetlands will <br />not be constructed on and a conservation easement will <br />be provided. <br />Mayor Van Nest stated that wetlands have to be defined. <br />Wetlands are not commercial property. <br />(Continued)
