TO; <br />FROM: <br />DATE; <br />Planning Commission and Council <br />Jeanne Mabusth, Zoning Administrator <br />September 18, 1980 <br />SUBJECT: #583 Development Group, Inc., 3701 Shoreline Drive <br />REZONING <br />WORK SESSION <br />Council directed the applicant to file a rezoning application with <br />the City before thty could complete review of the original variance, <br />conditional use permit and commercial site plan review. The current <br />B-1 lot is severely limited by encroaching wetlands and restrictive <br />standards of B-1 zoning district. Although the application proposes <br />office use (allowed in B-1 with a conditional use permit), the project <br />would be subject to the most restrictive standards of B-1. By rezoning <br />property to B-4, applicant benefits with less restrictive standards and <br />the City by approving development of a severely limited site from future <br />B-1 uses having greater parking demands. <br />Council did not specify the extent of the B-4 zoning district. Planning <br />Commission is asked to recommend adequate boundaries. The legal notice <br />will define a very broad area to be considered in the rezoning. The <br />Planning Coi.'.mission may determine a much narrower corridor. Council <br />did direct that the entire commercial use must be included in rezoned <br />area. The commercial zone must now extend to the west line of Lot 6. <br />Points to be considered in determining depth of zoning corridor; <br />1. Wetlands determined to be at 935 contour line - no matter where <br />zoning line is located, a variance from wetlands must be considered. <br />2. Line could be defined so as to alleviate need for variance from <br />rear yard bordering on residential zone (30'). <br />3. Proposed line could align itself with extent of commercial use '>n <br />east lot - a depth of 200*. <br />A rezoning hearing has been scheduled for October 6, 1980 at 7:30 P.M.
