#582 <br />TO:Council <br />FROM:Jeanne Mabusth, Zoning Administrator <br />DATE:September 11, 1980 <br />SUBJECT: Zoning Update - Site inspection of H.R. Johnston Property <br />On an inspection of the Johnston property with the assessor on 9-8-80, <br />we found that a major roadway had been constructed throughout the entire <br />peninsula including grading and tree cutting on City property at the end <br />of the point. Johnston did this without a permit and without any type of <br />plans. He had talked with staff several times and been advised not to do <br />any work until the City review was completed. He has since received three <br />citations and been advised to get his subdivision application underway. <br />He filed a six lot subdivision application on September 11, 1980, which <br />includes the property he hopes to acquire from the City. <br />Staff advises that if the sale does not take place, that Mr. Johnston <br />be responsible for restoration of the City property. A bond or irrevocable <br />letter of credit should be filed with the City and the applicant enter into <br />a contract (developers agreement) to assure the completion of the restoration <br />no later than July 1, 1981.
