Olson, Village Planner <br />DATE;July 16,- 1980 <br />SUBJECT; #546 Variance - Jack Rhode, 1410 Bohns Point Road <br />This application is an amendment and renewal of Item 210 approved by <br />the City Council on November 14, 1977. Due to litigation, and perhaps <br />other factors, the variance conditions were never agreed to by !*r. Rhode <br />(no signature on Resolution #851) and construction has never comirienced. <br />Staff is treating Item #546 as a new application because of the time <br />lapse and because this proposal is for a redesigned house, with a request <br />to change the previously determined lakeshore setback line. <br />Council heard the matter on June 30, 1980 and referred it to the Planning <br />Commission for fact finding on those changes from the plan approv'ed in <br />1977, which changes include; <br />1. Lake setback line; determined as line D to D to C in 1977, proposed <br />as line D to D in 1980. Compare Exhibits 3 & 8. <br />2.Hardcover; 1977 hardcover, including driveway, was 6,500 s.f. <br />1980 hardcover proposed is 8,300 s.f. In 1977, a gravel driveway <br />was proposed and was not at that time considered to be hardcover, <br />therefore no hardcover variance was required. See Exhibit 17C. <br />Today, gravel drives are considered hardcover. Applying this <br />determination, an 8% hardcover variance would have been required <br />in 1977. This compares to a 17b% variance per Exhibit 3. The <br />Council expects a recorrimendation for their July 28, 1980 meeting. <br />A cabin existed on this lot until 1974 or 1975. The remains were not <br />completely removed until after Hr. Rhode's purchase in 1976. <br />A lot area and lot width variance was approved in October, 1974 for <br />Fred Rogers "subject to no other variances, removal of the cabin <br />and removal of t)»e (still existent) carriage house". It expired. <br />A renewal request (#79) by Rogers in 1975 v;as tabled pending completion <br />of the cabin demolition which had been left half done. This application <br />was never completed. <br />Rhode purchased the lot and applied for a lot area and lot width variance <br />(#210) in 1976. The first request would have built a house at the 75 ft. <br />setback line all across the lot. Neighbor Becker objected and lobbied <br />for no variance or for placing the house behind a line shown as A - A <br />on the new Plan, Exhibit 3 (i Exhibit 9).
