MINUTES OF THE PLANNING COMMISSION MEETING OF MAY 4, 1981 Page 4 <br />Mr. Jeff Watson, Mr. Evans attorney, was present. <br />iMabusth noted the application involves a request to <br />release a portion of a flowage easement not really <br />involved in wetlands. In the original plat of <br />the Stielow Addition the wet lands was incorrectily <br />judged to involve a more extensive area of the pro <br />perty. Staff has restaked the wetlands area for <br />t\ia surveyor. A public hearing has been scheduled <br />for June 1st. Mabusth will seek the a-vvi e of the <br />city attorney as to the best method to achieve the <br />vacation. <br />The code's fence standards should distinguish between <br />the densly populated lakeshore ares and the rural <br />area of Orono. All agreed that retaining walls and <br />fences should be dealt separately with in the or <br />dinance. A fence or wall should be considered a <br />structure if footings are required. <br />The code should be quite specific as to prohibiting <br />petroleum base (or any other harmful chemicals) <br />treated woods within the O'75' setback of the lake- <br />shore. <br />The Planning Commission unanimously agreed that no <br />fence should be allowed: <br />1) Within 0-75' of lakeshore <br />2) If house is set closer than *75' or farther then <br />75’ from lakeshore - a fence could be constructed <br />at the average setback line determined by the prin <br />ciple structure of each adjacent lot. <br />Lakeshore lots would be allowed fences at a maximum <br />height of 6' - degree of opaqueness need not be con <br />sidered as long as the fence meets the proper setback. <br />The Planning Commission voted 3 to 2 against any need <br />for fences around swimming pools and stated that staff <br />would be the better judge. <br />Minority of 2 felt that fences were necessary in densly <br />populated areas of the City. <br />Hammerel moved to approve the minutes of April 17, 1981. <br />Goetten seconded. <br />Meeting adjourned at 9:55. <br />A.H.
