Vote: Ayes (6), Nays (1). <br />Minority opinion-McDonald said we should acknowledge <br />the Conditional Use Permit application and grant it <br />as such. It is a commercial use on a residential <br />piece of property not a quasi commercial. <br />The applicant was present. Mabusth explained that a <br />setback variance is required for the proposed horse <br />barn 30 x 45'. The barn has been located at the most <br />central location, a 28* setback is required on both <br />side yards. The Planning Commission also noted that <br />the applicant requires an area variance for 2 horse?. <br />The required area for 2 horses is 4 acres and the <br />subject lot has 3.9 acres. <br />Hammerel moved to approve the variance application <br />of Judyne Hassel with the understanding that 3.9 <br />acres could not support more than two horses based <br />on the following hardships: <br />1) No additional land available <br />JUDYNE HASSEL <br />2550 Sixth Ave. N< <br />Variance ^ <br />#604 <br />2) Existing lot width <br />and subject to the condition that the applicant submit <br />written proof of neighboring property owners on east <br />and west that they do not object. <br />Motion seconded by Jabbour. Vote: Ayes (7), Nays (0). <br />The applicant was present. Tom Jacobs presented the DOROTHY PORCIER <br />application. Jacobs noted the application is the 4780 North Arm <br />same one reviewed and approved by Council in June of Drive West <br />1977. The Planning Commission discussed the question Variance <br />of requiring the applicant to submit proof of contract: #605 <br />with an agency to clean up the debris on lot. The <br />Planning Commission decided this could best be enforced <br />by staff during the construction period. <br />Jabbour moved to approve the renewed variance ap <br />plication of Dorothy Forcier based on the following <br />hardhships; <br />1) Small lot restricted by 2 acre minimum standards. <br />2) Location of house on lot <br />and subject to the following conditions: <br />1) Applicant is responsible for clearing the debris <br />stored on property.
