\r. <br />o <br />PLANNING COMMISSION MINUTES OF FEBRUARY 2, 1981 PAGE-2 <br />purpose of constructing 3 residential units within <br />the existing structure at 3220 Navarre Lane. <br />The project is most attractive for the property would <br />return to residential use and the proposed conversion <br />would make use of the existing structure. The appli <br />cation is denied based on the following findings: <br />1- project too amibitious for a .25 acre lot. <br />2- proposal does not meet standards of a 3 unit PRD <br />a) lacks required area <br />b) lacks required setbacks <br />c) open space <br />3- setback variance for access driveway. <br />4- setback variance for offstreet parking <br />5- lack of demonstrated hardship <br />Motion seconded by Jabbour. Vote: Ayes (6), Nays (0). <br />Jerome Kroger was present. There was no one present <br />in the audience to address the application. <br />Adeuns asked what type of legal arrangement Kroger made <br />with owner of property. The subject property is div <br />ided into 3 parcels totaling 10 acres. What would <br />happen to the conditional use permit if one of the lots #601 <br />was sold reducing the required 10 acres of area. Ap <br />plicant stated he will lease the property and at a <br />future date buy the entire site to build a home. <br />JEROME KROGER <br />2450, 2500 and <br />2550 Sixth Ave <br />North <br />Conditional <br />Use Permit <br />Chairman Hammerel advised him of the wetlands and The <br />Flowage and Conservation easement over the designated <br />area. Applicant stated he could easily abide by all <br />restrictions noted in the easement. <br />■i <br />Hammerel moved to approve the conditional use permit of <br />Jerome Kroger for the purpose of planting a tree and <br />shrub nursery subject to the following conditions: <br />1- eastern access to be moved further west <br />2- designate wetlands area on site plan and make ad <br />justment for appropriate plantings <br />3- the conditional use permit runs with the 3 lots <br />any change of ownership, except for applicant's <br />purchase, will require a new review <br />Motion seconded by Adeuns.
