Mabusth <br />DATE:July 15, 1981 <br />SUBJECT:#636 Audrey Ogland, 2601 Casco Point Road <br />Conditional Use Permit <br />v'\.T <br />Zoning District - LR-IC <br />Application - Work Session - Conditional Use Permit <br />per section 34.027 - guest house <br />Lot Area - approximately 18,000 sf <br />required 21,780 sf <br />Lot width - 98' <br />required 100' <br />The applicant seeks a conditional use permit to construct a <br />mother-in-law, non rental unit above the existing garage. <br />Please review the face of the application reviewing her reasons <br />for the request. <br />Our code classifies such use as a guest house use requiring^ <br />all regular lot requirements for the guest house. The lot is <br />under the required 1 acre of area for 2 residential units and <br />the required lot width of 200'. <br />The City is consistent in denying such requests when <br />the required lot standards are not met. We can certainly <br />understand Mrs. Ogland's problem but this clearly cannot affect <br />our responsibility to interpret the code fairly and equally <br />for all residents. <br />Plannning Commission may recommend as a compromise position <br />the construction of a mother—in—law apartment within the prin^ <br />cipal structure. The apartment unit would be allowed a sep­ <br />arate kitchen and bathroom but an interior access would have <br />to be designed through the principal residence. Apartments <br />of this type cannot be allowed independent accesses. This <br />type of design consideration will prevent rental of the unit <br />when the Oglands no longer own the property. <br />This is just a work session item, Mrs. Ogland may take the <br />opportunity to review her situation. The application will <br />be rescheduled for action when Mrs. Ogland determines the <br />scope and type of application to be acted on. <br />*
