Luckily, those deeds created parcels that <br />can conform to zoning requirements without changes. If they had <br />not, such transfers would not have been able to be approved. <br />An "after the fact" application such as this one is subject to <br />the statutory penalty fee provided to reimburse Cities for the <br />extra staff time and confusion necessary to deal with such un­ <br />approved subdivisions. Minnesota State Statutes Chapter 462.358 <br />Subdivision (4) states: <br />"Any owner or agent of the owner of land who <br />conveys a lot or parcel in violation of the <br />provisions of this subdivision (by metes & <br />bounds without City approval) shall forfeit <br />and pay to the municipality a penalty of not <br />less than $100 for each lot or parcel so <br />conveyed." <br />Consequently, I am enclosing a statement xor each of you, Peters, <br />Gehrman and Hagfors, to pay to the City a $100 penalty fee ($300 <br />total) to reimburse the City for the extra added expenses of this <br />application. The total application fee including penalty is $590. <br />This penalty should be received by the City before the August 3, <br />1981, public hearing. <br />Along with this letter I am enclosing for your information a copy <br />of my memo regarding TMG and Winters. <br />I thank you for working with Mr. Winters and the City to finally <br />make this application and to resolve the problems created by the <br />previous parcel divisions. I expect to work with you to effec­ <br />tively complete the review and record an approved subdivision as <br />quickly as possible.
