Viewed as a lot line re­ <br />arrangement, this also meets the intent of our <br />zoning code. <br />SUBDIVISION APPLICATION <br />This application is consequently a 4-lot lot-line rearrangement <br />subdivision. No new building sites are created although the <br />subdivision does clear titles and records to allow construction <br />on the Winters parcel. <br />PENALTY <br />In addition to the normal subdivision application fee, a $300 <br />penalty fee has been charged for the 3 unapproved lot transfers <br />per Minnesota Statutes Chapter 462.358 Subdivision (4): <br />"Any owni'v or agent of the owner of land <br />who conveys a lot or parcel in violation <br />of the provisions of this subdivision shall <br />forfeit and pay to the municipality a <br />penalty of not less than $100 for each lot <br />or parcel so conveyed." <br />This fee is used to pay for the unusual staff expenses and time <br />involved in handling after-the-fact subdivision applications. <br />In this case, staff has worked many hours over 3 years or more <br />with several different parties including Winter's attorney to <br />finally see an application made to resolve the problems created <br />by the unapproved subdivisions.
