I! <br />■ I <br />.ii <br />ii <br />>*V <br />V . <br />i^:,j <br />I <br />' <br />rzz“^rr ^SiSgBr» ^r <br />Craig Winters <br />Page 3 <br />Gehrman Lot Robert Gehrman, 4300 Sixth Avenue North <br />Final result is one residential lot of about <br />11 acres made up of two parts: <br />a) The existing Gehrman residential parcel <br />(lots 2 & 3 combined) : 3.46 acres <br />b) Part of parcel 1185 : 7.53 acres <br />Combination of both parts into one parcel is <br />necessary because part (b) would otherwise be <br />an unapprovable landlocked parcel and because <br />combination will make the Gehrman residential <br />lot fully conforming with all RR-IA standards. <br />Hagfors Lot Curtis Hagfors, 4360 Sixth Avenue North <br />Final result is one residential lot of about <br />2.24 acres made up of two parts: <br />a) The existing Hagfors residential parcel, <br />lot 6 : 1.15 acres <br />b) Part of parcel 1185 : 1.09 acres <br />Combination of both parts into one parcel is <br />necessary becuase part (b) would otherwise be <br />an unapprovable substandard, landlocked parcel <br />Combination does not make the Hagfors lot into <br />a conforming 5 acres but it does improve the <br />lot area conformity. Viewed as a lot line re <br />arrangement, this also meets the intent of our <br />zoning code. <br />SUBDIVISION APPLICATION <br />This application is consequently a 4-lot lot-line rearrangement <br />subdivision. No new building sites are created although the <br />subdivision does clear titles and records to allow construction <br />on the Winters parcel. <br />PENALTY <br />In addition to the normal subdivision application fee, a $300 <br />penalty fee has been charged for the 3 unapproved lot transfers <br />per Minnesota Statutes Chapter 462.358 Subdivision (4): <br />"Any owni'v or agent of the owner of land <br />who conveys a lot or parcel in violation <br />of the provisions of this subdivision shall <br />forfeit and pay to the municipality a <br />penalty of not less than $100 for each lot <br />or parcel so conveyed." <br />This fee is used to pay for the unusual staff expenses and time <br />involved in handling after-the-fact subdivision applications. <br />In this case, staff has worked many hours over 3 years or more <br />with several different parties including Winter's attorney to <br />finally see an application made to resolve the problems created <br />by the unapproved subdivisions.
