Olson, City Planner <br />DATE:March 25, 1981 <br />SUBJECT:Ordinance Revisions - Fences <br />Existing Regulations <br />1.Sections 31.433 and 31.434 permit certain fences and walls <br />(along with other items) as "non-encroachments" into required <br />yard areas. No setback is required. <br />31.433 permits fences not over 3-1/2 ft. high in any yard, <br />or fences not over 6 ft. high along the front lot <br />of the lake frontage lots abutting a major thoroughfare <br />31.434 permits fences and walls not over 6 ft. above grade in <br />any aide or rear yard. <br />Sections 35.047, 35.282, 35.357 & 35.446 require 6 ft. fencing <br />(or natural screening) in B-1, B-3, B-4 & B-5 zones abutting <br />residential property. <br />Sections 35.501 6 35.551 . squire 6 ft. fences or walls (or <br />landscaping) between gas stations or driveins and residential <br />property. <br />Section 37.100 defines required screening as a solid fence or <br />wall at least 50% opaque. Natural plantings are "in addition <br />to" required fencing. <br />The State Building Code Section 301^2 does not require a <br />building permit for fences 6 ft. high or less. <br />Issues <br />1. Fences are permitted in lakeshore yards which may adversely <br />affect views.
