-IT <br />-V A <br />O <br />PLANNING COMMISSION MEETING OF NOVEMBER 15, 1982 <br />At 7:45 P.M., Chairman Hconmerel announced that now <br />was the time and place for the public hearing <br />to consider the preliminary subdivision request of <br />Victor Norton, 3580 Bayside Road. Zoning Adminis-* <br />trator Mabusth presented the Notice of Public <br />Hearing, Certificate of Mailing, and Affidavit of <br />Publication. <br />Mr. & Mrs. Norton were present; also present: Gerald <br />Gustafson, 200 Bederwood Drive, and Alvin Balgaard, <br />3560 Bayside Road. <br />Discussion included the motive for the subdivision to <br />be used for riparian rights only; that the division <br />does not create two unbuidable lots; that it be made <br />in^ossible to build on; the relation of Mr. Balgaard's <br />property to the property for location of his dock, and <br />that a precedent not be set for such subdivisions. <br />Chairman Heunmerel closed the public hearing at 8:00 P.H. <br />Member Goetten moved, Rovegno seconded, to table the <br />preliminary subdivision request of Victor Norton, <br />3580 Bayside Road, for review and advice from the <br />City Attorney concerning the question of platting the <br />property to achieve riparian and buildability controls, <br />and the possible need to realign the lot lines of <br />Parcels A & B so that portions of Parcel B are located <br />directly across Bayside Road. Motion, Ayes (6) - Nays (0). <br />Page 2 <br />PUBLIC HEARING <br />3580 Bayside Road <br />#715 <br />Victor Norton <br />is' P <br />At 8:10 P.M., Chairman H2unmerel announced that now <br />was the time and place for the public hearing <br />to consider the preliminary subdivision request of <br />James Hartzell, 2987 Casco Point Road. Zoning <br />Administrator Mabusth presented the Notice of Public <br />Heaucing, Certificate of Mailing, and Affidavit of <br />Publication. <br />PUBLIC HEARING <br />2987 Casco Point <br />#712 <br />James Hartzell <br />Mr. Rick Sathre was present representing Mr. Hartzell. <br />Zoning Administrator Mabusth explained the need for <br />the 30* right of way. <br />Discussion centered on the 30* right of way, some of <br />which is already on the subject property; and that the <br />tennis court on Lot 1 contains the majority of the <br />hardcover allowed, so that no principal building can be <br />located on Lot 1 at a future date without the need for a <br />variance. <br />Chairman Hammerel closed the public hearing at 8:30 P.M. <br />Member Callahan noved, Kelley seconded, to approve the <br />three-lot plan as presented for James Hartzell, 2987 Casco <br />Point Road, finding that all lots meet the standards of <br />the LR-IC Zoning District and to approve the existing <br />6% hardcover variance on Lot 1 created by the tennis court; <br />(Continued)
