Motion - Ayes (7), Nays (0). <br />The Planning Conmission made the suggestion to Mr. Becker <br />that he withdraw his original proposal and change it to <br />subdivide this parcel into 4 lots instead of the initial 5. <br />Mr. Becker agreed. Van Nest moved, f4d)onald seconded, to <br />conceptu^ly approve this subdivision of 4 lots instead of <br />the original 5 as all lots would meet minimum acreage. <br />Motion - Ayes (7), Nays (0). <br />Chaiiwoman Dunlap announced that this was the time and place <br />for the continued public hearing on the petition of William <br />Wear for a conditional use permit. <br />The Zoning Administrator reminded the Commission that he had <br />sent them a copy of letter that the State Highway Department <br />had written to William Wear stating their approval of the <br />design, location and sight distance of the two accesses to <br />this service station. Mr. Wear presented his site plan to <br />the Comnission showing the location of the gas pumps, ingress <br />and egress and interior finish. In August 1972 Council <br />i^roved the gasoline concept. <br />Pete Rettinger and Bob Neddeimeyer were present and objected <br />to the operation cf the gas pun^js. They felt that he was <br />using these pumps as a leader to bring people into the <br />shopping center. They felt it could ^rm their business and <br />the other gas stations m the area because of the low cost <br />Mr. Wear would be charging for his gas. Member Pesek <br />advired Mr. Rettinger and Mr. Neddeimeyer that the Plemning <br />Conmission cannot make any business decisions. After all <br />the public were heard, the continued public hearing was <br />closed at 8:30 p.m.. <br />The Planning Commission continued to discuss this conditional <br />use peimit. Guthrie moved, Pesek seconded, to approve this <br />application because the property is located in a commercial <br />zone, the letter from the Highway Department approving of <br />the accesses to this service station and Council’s prior <br />approval of this service station.
