r <br />\ ' ' <br />m <br />© <br />O <br />MDUTES OF A FLAWING OOlfllSSICN ^^EBTING HELD AUGUST 2, 1976 - PAGE 2 <br />Chaiiwonan IXnlap called to order the Regular Meeting of <br />the Orono Planning Conmission. <br />Pesek moved, Guthrie seconded, that the minutes of the <br />Planning Ccomission meeting of July 19, 1976, be approved. <br />Motion - Ayes (8), Nays (0). <br />Mr. Peterson explained to the Planning Gomnission that he <br />had purdiased this property about 1 year ago. He under­ <br />stood there were misun^rstandings, but felt that the <br />problems had been solved. The Peterson's purchased this <br />property in good faith. <br />Pesek moved. Van Nest seconded, to approve this variance <br />because it is after the fact and the pool has been there <br />for the past three years. Pesek felt that this was not a <br />violation by the Peterson's idio purchased the property only <br />one year ago. They were unfortunate to inherit an existing <br />non-confbming situation whidi was never before brought to <br />the attention of staff. Motion - Ayes (8), Nays (0). <br />Mr. Curtis was in attendance and presented pictures of his <br />property. After a short discussion, McDonald moved, Pesek <br />seconded, to grant approval of this variance because the <br />proposed addition would be replaci^ the substandard leanto <br />portion of the house and it would in no way encroach on the <br />existing setbacks. Motion - Ayes (8), Nays (0). <br />The Zonii^ Administrator presented the building plans to <br />the Goonission. Mr. l^an was present to explain his plan <br />for this addition. Van Nest moved, Guthrie seconded, to <br />recommend approval subject to providing fire separations <br />as required by the State Code and the coid>ination of all <br />tlie ixidividual parcels and vacated street. The subject <br />of the vacated street should be referred to the attomey <br />to resolve its actual status. <br />Mr. 6 Mrs. Smith were in attendance. Mrs. Smith explained <br />to the Coamission that at the start of the construction <br />they instructed the contractor not to disturb the trees <br />that were on the property in order to build the house. <br />The location of the house was then moved over to avoid <br />removing the trees. The inspector was never informed <br />of the change in location. Larry Shaw, a neighbor to <br />the north of the Smith's was also present at the meeting. <br />He expressed his dis^pointment with the building of this <br />home. He mentioned that he conplained several times to <br />the building inspector regarding the building location. <br />The present location of the Smith's home bloc] <br />of the lake. The Planning Conmission felt that the only <br />^- - - - - - - - - - -- <br />blocks his view <br />question here was the rear yard setback as the new <br />location still met all sideyard setback requirements. <br />Pesek moved. Hake ^ond^, approval of this variance <br />because the house is finished.
