Bordcovcr: <br />The property is located in the Shoreland area. It is located within the 500* • 1.000* setback to the high <br />water level of French Lake. The total proposed hardcover is 3,536 s.f. (21.5%) where 5,759 s.f. <br />(35%) is allowed. Total lot area is 16,455 s.f. <br />New Hardcover <br />672 s.f. for the new detached garage <br />144 s.f. for the new driveway access <br />STATEMENT OF HARDSHIP <br />Applicant's hardship is included with Exhibits A and B. The applicant should also be asked for <br />their testimony regarding this issue. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property is being put to a reasonable use because it contains a single family residence. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The garage would be constructed with the doors facing towards Minnetonka Avenue which <br />is consistent with other garages in the neighborhood. IVhat circumstances prohibit <br />placement ofthe garage between the tree and the house to allowfor a greater street setback? <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance would not change the character ofthe locality. The development pattern ofthe <br />lot is in character with the general development pattern of the Crystal Bay neighborhood <br />4. Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration. <br />5. Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />6.
