C. In subdivision approval, the setback required for the oversize accessory structure as defined <br />herein shall remain. <br />Such covenant shall be binding on current and future property owners and shall be filed in the chain <br />of title of the property. <br />Horse Bams <br />Horses are a permitted accessory use in the RR-1A district. The minimum setback for a private bam <br />from any lot line is 75 ‘. The minimum setback from adjacent residences is 150*. The bam location <br />meets standards required for special setback regulations that apply to private bams and stables. <br />Property Background <br />The property was part of the recent 6 lot plat of Kokesh Farm. This lot is a record lot meeting <br />minimum lot size and lot area requirements for the zoning district. Earlier this month the City of <br />Orono issued a demolition permit and the old non-conforming house and garage were removed. The <br />house was non-conforming because it was located within the 100* front yard setback. <br />A 50 ’ pasture casement is located over the south 50 ’ of this property. The easement w as recorded <br />by the developer of Kokesh Farm and is for pasture use by the propery owner to the south. The <br />proposed development does not impact the 50 ’ easement. <br />Zoninu/Scntic Review <br />Front yard setback ± 400 ’ <br />Rear yard setback 125' <br />Side yard setback (south) +200 ’ <br />Side yard setback (north) 98' <br />The new house meets all required setbacks. The house wns located to take advantage of e.xisting <br />topography for a wnlkout and to locale the building a greater distance from the street. <br />New soil testing and septic design has been submitted by the properly owner and approved by the <br />City On-Site Systems Manager. The final septic design is for a 4 bedroom house but could be <br />expanded to a 5 bedroom if needed. <br />Staff Rccomnieadatton <br />Staff recommends approval of the variance to permit the oversized accessory building to remain on <br />the property based on the existing building location, the best building site on the lot is located behind <br />the bam, and it allows for a w'alkout at the highest lot elevation. <br />•01-2734 Mwgie Kewloa <br />305 Otduvd Parti Road <br />P^2of3
