CONCLUSIONS, ORDER, AND CONDI I IONS <br />Based upon one or more of the above findings, the Orono Ciiy Council hereby grants <br />variances to Municipal Zoning Code Section Section 1 0.03, Subdivision 9 (A) to permit an accessory <br />building (bam) to remain on the property absent a principal residential structure and to permit a 620 <br />s.f. addition to the bam; Section 10.03, Subdivision 9 (D) to permit the bam to be located closer to <br />the front property line than the principal building; Section 10.03. Subdivision 9 (C) 3a to pcmiil an <br />oversized accessory building to be located closer to the front property line than ihe principal <br />building; and Section 10.03, Subdivision 14 (D) to permit a riding arena (paddock) to be located <br />closer to the front property line than the principal residential building subject to the following <br />conditions: <br />1 . The property shall be developed in confomiance w ilh the site plan attached hereto as <br />E.xhibit A. <br />3. <br />The property owner signs and agrees to filing an oversized accessory structure <br />restrictive covenant subject to the restrictions as stated in the Municipal Code. <br />Authorities granted by the variances mn with the property not with the applicant, but <br />arc permissive only and must be e.xerciscd by application for a building permit w ithin <br />one year of the date of Council approval, or these variances will expire on that date <br />(November 26.2002). <br />Violation of or non-compliance with any of the terms and conditions of the variances <br />shall constitute a violation of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable os a misdemeanor. <br />The undersigned owTier has read, understands and hereby agrees to the tcmis of this <br />resolution and on behalf of herself, her heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the Chain of Title of the property. <br />Page 4 of 7
