H.The bam is proposed to be appn>ximately 1,700 s.f. in size. The Municipal <br />Code permits one oNcrsizcd accessory’ building on a lot subject to the <br />condition th ouilding meets all a'quired principal building setbacks and <br />property owmrr shall agree to covenants that state: <br />a) No future subdivision will be approved that places the structure within <br />a lot that has no principal structure, except that the City in its subdivision <br />approval may grant a finite time period in which the oversized acccssorv ’ <br />structure may remain without a principal structure, in ord**r that a principal <br />stmctuie may be constructed. At the end of this time period the oversized <br />accessoiy structure must be removed if no principal structure has been <br />constructed. <br />b) If the property is subdivided, the oversize accessory structure and <br />principal structure will be located together within a lot that meets the <br />minimum lot area requirement for tlie given size of accessor)’ building. <br />c) In subdivision appioval. the setback required for the oversize accessory <br />structure os defined herein shall remain. <br />The City Council finds that the conditions existing on this property are i>eculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variances will not adversely aflect trafllc conditions, light, air. nor pi>se a fire hazard <br />or other danger to neighboring property; would not merely serve as u convenience to <br />the applicant, but is necessary to alleviate a demonstrable hardship or difficulty: is <br />necessary to preserv e a substantial property right of the applicant; and would be in <br />keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicant and the effect of the proposed variance on tlic health, safety and <br />welfare of the community. <br />Page 3 of 7
