A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE SECTION 10.03, <br />SUBDIVISION 15 (C) <br />FILE NO. IW1.2726 <br />WHEREAS, Kevin Gamctl (hereinafter -ihe owTicr") is ouTicr of the property <br />located at 450 Orchard Park Road within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Attached “Exhibit A” (hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on October 15, 2001 at which times all persons desiring to <br />be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the owner has applied to the City for a variance to Municipal <br />Zoning Code Section 10.03, Subdivision 15 to permit a 6 foot fence to be constructed within <br />the 50' front and 50' side yard adjacent to the street setback where a fence height of 3 '/> feel <br />is allowed; and <br />Minnesota: <br />1. <br />2. <br />NOW. THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />FINDINGS <br />This application was reviewed as Zoning File <(01-2726. <br />The property is located in the RR-IB One Family Lakeshore Residential Zoning <br />District wliere 2 acres is the minimum lot area requirement. The property has <br />a lot area of 14.5 acres. <br />The Orono Planning Commission re\'icwed this application on September 17. <br />2001 and recommended approv'd! on a vote of 6 to 0 to approve the variances <br />as requested based on the followii^ findings: <br />A. The relationship of the property is unique because of the property being <br />a comer lot and is 14.7 acres in size. The lot also has extensive <br />vegetation that would be available to screen most of the fence. <br />Page I of 6
