CITYOFORONO <br />PARKS. OPEN SPACES AND TRAILS COMMISSION MEETING <br />MONDAY, JULY 2,2001 <br />H <br />points. Nygard suted the DNR has indicated if the cities do not start utilizing these lake access <br />points and fire lanes for public good, the DNR may take them back. Nygard expressed frustration <br />rhat the markers at this lake access point have been pulled, noting it costs the taxpayers money to <br />have the land surveyed and marked, and that a complaint has been filed with the Police <br />Department. <br />Nygard stated since this is a fire lane, there is driving access, and to his understanding it has been <br />classiHed for snowmobile access. Nygard suted in his opinion this lake access point should be <br />made available to the neighbors and that a satisfactory conclusion can be reached in this situation. <br />McDermott clarified that this lake access is a platted road and not a fire lane, with the Park <br />Commission having voted to recommend that this be classified as a swimming beach with no <br />snowmobile access because Orono’s Ordinance does not allow both. <br />Gappa suted there is a 60 foot wide platted right-of-way in this area, which was platted back on <br />July S, 1921. Gappa illustrated on the overhead where the location of the lake access is. Gappa <br />suted the row of arborviue is close to one edge of the right-of-way. Gappa noted he does have <br />photographs of the location of the stakes and that the markers could be replaced from the <br />photographs. <br />Bull inquired why the property owner was not told at the time of construction that this may be a <br />problem. <br />Gappa stated a portion of the driveway is located on public land, which should not prevent people <br />from having access to the lake. Gappa stated if this is classified as a beach, motorized traffic <br />should not be allowed. <br />McDermott noted the City Council would make the ultimate decision on how this lake access <br />point should be classified. <br />Bull inquired whether they should speak to the City Council about having this area regraded. <br />McDermott noted grading is not allowed within the 0-75* zone, and that perhaps some steps or <br />safe pathway could be established. <br />Gappa suted in his opinion this area has not been regraded outside of the area for the driveway, <br />which was relatively flat at the time construction commenced. <br />Mr. Line indicated they have not changed the grade in this area either to the north or south. Line <br />staled the area is overgrown w ith brush. <br />Meyers suted the Park Commission feels there should be access in this area, but that the exact ' <br />location of the access is undetermined at this time. Meyers stated the access might be different <br />than what it was in the past. Meyers staled the issue is that the neighbors are allowed access <br />down to the lake. <br />McDermott suted at this time the Park Commission has recommended to the City Council that <br />this area be classified as a swimming beach, with no motorized vehicles being allowed. <br />PAGE 4
